This sample agreement is for informational purposes only.  Upon Lake Travis Lodging's approval of a rental application, an agreement customized for the renter and the home selected will be sent, usually via email.  The customized agreement will differ from the sample agreement below.

IT IS UNDERSTOOD AND AGREED AS RENTER OF LAKE TRAVIS LODGING THAT:

1.        RESERVATIONS CONFIRMED  Your credit card has been charged a reservation deposit (1/2 of total rent) and an application fee as detailed above.  If you are paying by check or money order, your reservation fee and application fee is due within 7 days.  If the reservation fee and application fee is not paid within 7 days, your reservation will be canceled without notice.  The application fee is non refundable.  The balance of the rental amount, a cleaning fee, and a damage/security deposit (if applicable) is due prior to your arrival date.  If paying by check or money order, you should arrange to pay in full 7-business days prior to arrival.   If paying by credit card, your credit card will be charged a few days before check in.  State and city tax will be collected.  12% Lago Vista, 13% Jonestown, 6% all other areas.

2.        CANCELLATION  All refunds subject to a $35 cancellation fee.  Thirty days or more prior to arrival – full refund less cancellation fee.  14-29 days prior to arrival, a charge of ˝ of one night’s rental fee plus cancellation fee, 3-13 days prior to arrival, a charge of one night’s rental fee plus cancellation fee, 2 days or less prior to arrival – a charge of two night’s rental fee plus cancellation fee.

3.         DAMAGE/SECURITY DEPOSIT  Refunded within 14 – 21 days after departure.  Deductions will be made for lost keys, damage, missing items, and excessive cleaning.   A $35 fee will be charged if it is necessary to provide an additional key due to lockout.

4.         RESPONSIBLE PARTY  The name appearing on the reservation is RESPONSIBLE for payment and the actions of all occupants.  We do not accept multiple payments from different parties.

5.         ARRIVAL/DEPARTURE  Arrival time is after 4 p.m. on the day of arrival.  Departure time is by 12:00 noon the day of departure.  Early arrival or late departure without prior approval will result in an extra days rent being charged.  Four hour blocks of time for an early arrival or late departure are often available if scheduled in advance.   The rate for a 4 hour block of time is 1/3 of one night’s rent.  There is no refund or discount for unused rental time.

6.         ERROR/OMMISSION  The owners and Lake Travis Lodging will exercise care in avoiding conflicts with reservations; however, if through error/omission, the owners or other tenants are occupying the rental unit or the unit is otherwise unavailable for any reason on the dates of the rental agreement, and if substituted accommodations of a similar quality/price range are available when the error is discovered, Lake Travis Lodging reserves the right to provide such accommodations at a rate within the price range of this agreement.  Such arrangements may be accepted, or cancellation of this agreement will result in refund of deposit as liquidation damages.  In no event will renter be permitted to demand removal of those occupying rental unit.

7.         UNAVAILABILITY   The rental unit may become unavailable for rental for various reasons, including but not limited to, acts of nature, governmental regulations, health or safety concerns, withdrawal of unit from the Lake Travis Lodging rental pool, and sale of rental unit by owner.  In the event the rental unit shall become unavailable for rental, Lake Travis Lodging will first attempt to place renter in a similar unit at an equivalent rental rate.  If no similar unit is available, Lake Travis Lodging will refund to renter all monies paid toward the rental.  Neither renter nor Lake Travis Lodging shall make any claims against the other because of the unavailability of the rental unit.

8.         CLAIMS  You agree to indemnify and hold harmless the owner, owner’s agent or employees, Lake Travis Lodging and its contractors and employees from any claim or demand arising from any use of the rental unit or property.

9.         STUDENTS  The rental unit is for families only, students require continuous supervision.

10.      NUMBER OF GUESTS  There shall be no more people in the rental unit than the unit will sleep.  This number is indicated above.  Use of tents or RVs is not allowed on the premises.  At no time during the rental period will there be a large party or group in the rental unit or on the property upon which the rental unit is located.  In the event that it appears too many people are in the unit or on the property where the unit is located, Lake Travis Lodging reserves the right to inspect the rental unit and require extra people to leave immediately.  Additional problems of any nature, or evidence that unlawful acts have been committed will result in all occupants of the rental unit property being required to vacate the premises immediately and loss of rents and deposits.  NO KEG BEER ALLOWED ON THE PREMISES.

11.      PETS are not allowed inside or outside the property (ies). Violation will result in cancellation of rental, eviction without notice, and forfeiture of all rents and security deposits. The amount that will be charged to renter for violation of this “no pets” rule is $1000.00 plus cost for repairs, replacements and cleaning required to restore the property to before the rental condition. Determination as to whether a violation of this “no pets” rule has occurred shall be solely determined by Lake Travis Lodging

12.      SMOKING  Not allowed inside or on decks.  Please restrict smoking to the exterior grounds of the property.

13.      EQUIPMENT FAILURE  There will be no refunds or discounts due to air conditioning, heating or appliance failures.  Failures will be repaired as quickly as possible.  We reserve the right to substitute an equal unit if necessary, or, at our option, to make a full refund.

14.      TELEPHONE  Available in this home.  Long distance may only be charged to credit cards.

15.      COOKING GRILL  Available in most units but use is NOT allowed on wooden patios or decks.

16.      LINENS  Linens shall not be removed from the rental unit at any time.  There will be a charge for linens that are missing/damaged and unusable.

17.      GARBAGE  Loose garbage is not to be placed in outside containers.  All trash must be tied in plastic bags, and must be placed in the receptacles provided

18.      BASIC NECESSITIES Rental units are furnished with basic necessities; however, you are responsible for bringing extra folding chairs for outside use, large plastic trash bags, toiletries, etc.

19.      CLEANING You understand that you are expected to straighten up the rental unit prior to departure.  All furniture should be returned to its original location.  Dirty dishes are not to be left in the kitchen sink, counter top or refrigerator.  If dishes are left in the dishwasher, we do ask that the dishwasher be turned on prior to your leaving.  No open or perishable food products that you have brought into the unit should be left behind.  You understand that failure to comply with the departure checklist provided by Lake Travis Lodging may result in an excessive cleaning charge to cover the additional cost of cleaning the home.

20.      BOAT DOCK  Due to unforeseen weather changes and varying lake levels the dock may not be functional at the time of your stay.  Lake Travis Lodging will make every reasonable effort to ensure it’s functionality but cannot guarantee it.

21.      INTERCOM The intercom system in this home is non-functional.

22.      ELEVATOR  The elevator is non-functional.  Access to levels 2 & 3 are by outside stairs only.

23.      FAX COPIES  Parties stipulate that fax documents are deemed as originals.

24.      BONFIRES There are to be no outside fires other than that of the BBQ Grill.

25.   Children are not permitted in loft.  Do not dive into the water from the dock. Hazards are below the water and can cause serious injury or death. The lake has inherent hazards - old rusted fishing tackle, fishing line, rocks, snakes, submerged objects, etc. Swim at your own risk and with a buddy.

I, as renter of the above property, shall uphold the above said rules and regulations and shall be responsible for any damages incurred other than normal wear-and-tear.  I fully understand and agree that evidence of unlawful activity or violations of this agreement or addendum may, at the sole judgment of Lake Travis Lodging, result in eviction, loss of rents and deposits paid, and/or in additional charges being billed to me and/or to my credit card.
